I think even if you drill out the handle now, and unscrew the trim plate on the front here, you should still be able to use the shower fine. You could still hold the handle on the valve to turn the shower on/off, or use a pair of pliers.

Hopefully there's a decent size cutout behind the trim plate so that you can get clshade's a good picture :)

Though I've seen people over on /r/DIY that only cut a hole for the handle/valve, making it impossible to service the cartridge or anything else.
 
If the cartridge is not in place there is nothing preventing the water from coming out of the whole assembly. It is your on/off/mixer. When I replaced one at the rental it was because it was no longer mixing properly. Was about $50/cartridge pricing obviously varies on model/source.

I suggest taking it all apart to get the model number off of it, and even within a single brand there might be a couple different models. With Pfister there was 2 common cartridges depending on the "model" of the tap.

the problem is I am not sure if a cartridge would or could cause a leak like that. I am not worried about people having to shower it's the fact that once I rip it apart I cant get to the hardware store to get replacement parts I need, meaning I won't be able to turn the water back on.

what I am pissed about is the fact that I have taken up everyone's time and now I can't even take the help offered till Monday when all I wanna do is fix this fucking thing and yes I will need CLshades help since the plumbing I can do its this damn bathtub valve's I know nothing about and his help is invaluable, so is everyone else's too since having to only replace the valve could save me a boatload of money if I don't have to replace and rebuild the whole damn thing with a new line and valve plus fixing the wall and everything I would need to buy to do said fix.

I am not digging into it until I have parts or can get them, the last thing I need is my water turned off and 3 women in my house bitching about it.

all I can do is hope Clshades can give me the help I need when it works for Him since he's the plumber. thanks, will post back once I get the thing drilled out Monday and take it from there.

I think getting the handle and trim off this weekend would be helpful so you can see what you're dealing with. Also would help track down where exactly the leak is coming from when it's "on" too.

Your rough-in valve might have stops built-in? Would explain why they didn't put shutoff valves in behind.

well, I can see right where the water is coming from, it's out of where the cartridge goes sorry I thought I said that already and I did double-check it to make sure, I can't pull anything apart cause if I cant turn the water back on all 3 women in my house all with small bladers will have nowhere to go to the bathroom, I plan on getting right into it first thing Monday cause my wife is home so I can go and get the parts or worse case if I have to replace the valve and run new PEX lines or wait for parts I can cut the lines and shark bite cap them which would fucking suck but none of this has smooth in any way shape or form.

Hell I wanted to do it all today and tomorrow but then I thought I could get to the hardware stores I needed to, I am just trying to not have to call a plumber which I can't really afford right now we have already dropped over 12g in the last 4 months. trust me all I want to do is go up to my bathroom and rip that shit apart but I cant cause of my family needing to us the water.
 
Once you're able to get to the hardware store, you might want to put some shutoffs in there(Sharkbite, PEX, whatever), if for no other reason than being able to shut the water off while dickin around figuring out the leak situation, and still be able to turn it back on intermittently, to allow some relief of those "small bladders".
 
Good old renos....... you never know until you peel back the layers. All you can do is fix it better than how you found it. The good thing is that you are willing to do it yourself and invest in some sweat equity. Good luck!
 
Ok here's the deal. Get the handle off. Once that's off and I can see what your dealing with you can pull the cartridge. You will need to turn the water off to do this or you're gonna have a bad time. If you're rough-in is like the 1st picture it has integral valves. Turn those so the flat bit is up and down, not sideways like the photo. If you don't have integral valves you need to shut the house off. Best to drain down the pipes before pulling. FYI you need to open a tap either on the same floor or the one above to get it to drain or it just gets air locked.

Get a new Moen trim kit and cartridge and re-install. All Moen rough-in valves (pic below) are the same and work with most basic Moen trim kits (last photo) The photo with the arrow is the cartridge. Don't lose the cotter pin/clip.

Someone mentioned sharkbite valves. They are great for going from copper to pex and you can turn the water on right away. The little white thing inside the valve MUST be removed on the copper side. Leave it for the pex side. Make sure the water shuts off by turning the handle DOWN. Tthat way if you bump it you don't get soaked. It's exciting when that happens :p

Here is the main problem with putting in a new valve. You will need to run copper for the tub spout. There is NO getting around this. So this means you have to pull the cartridge out and anything rubber needs to be removed prior to soldering. It also has be be perfectly square to the outlet and it has to line up with the existing holes. This is where things start to get dicey for the inexperienced.

Yes, removing the handle will not cause the cartridge to come out.
