I cannot dispute what you say per se, I do not know Canadian law. But I do remember a case about 5-6 years ago in Mississauga where some nutjob did indeed masturbate in front of his picture window and the case was thrown out with the judge explicitly stating that you should not be looking through someone's window, no matter the reason. I am certainly not against a person like that be prosecuted, but what we do inside our four walls is not the public's business.
I remember a similar case, but the facts presented demonstrated that the complainants had to go out of their way to view the behaviour. It wasn't a simple case of somebody exposing themselves in their front window, it was a case of needing binoculars to see a relatively secluded rear (or side) window.
